 Collection of Information
We collect personally identifiable information, like names, postal addresses, email addresses, credit card information etc., when voluntarily submitted by our members and-or visitors. The information you provide is used to fulfill your specific request, to improve the experience on our web site, and to ensure a successful experience at Cycle614. Cycle614 may also log non-personally-identifiable information including IP address, profile information, aggregate User data, and browser type, from Users of the site. This data is used to manage the Website, track usage and improve the Website services. This non-personally-identifiable information may be shared with third parties to provide more relevant services and advertisements to Users. User IP addresses are recorded for security and monitoring purposes. We may also record information about your usage, such as when you use the Cycle614 website. If you are logged in, we may associate that information with your account. We may use clear GIFs - a.k.a. “Web Beacons” - in HTML-based emails sent to our Users to track which emails are opened by recipients. We may also use a User’s email address to send updates, a newsletter or news regarding Cycle614. Users may choose not to receive email of these types by following opt-out instructions contained in such email. Cycle614 reserves the right to send you important notices about your account even if you opt out of all voluntary email notifications.

 Liability Waiver

READ THE PROVISIONS BELOW CAREFULLY, AS THEY INVOLVE YOUR LEGAL RIGHTS

For purposes of the following provisions, Cycle614 includes Cycle614 and its owners, officers, representatives, employees, agents, independent contractors, or insurers.

 General Liability Waiver and Indemnification Agreement

 Cycle614 is not responsible in any way for the safekeeping of your personal belongings while attending a class.

 Participation in classes at Cycle614, and the use of Cycle614’s services, facilities, equipment, and machinery could result in injury, permanent disability, or death, including but not limited to overexertion injuries (such as fainting, heat exhaustion, or rhabdomyolysis), broken bones, damaged connective tissue, herniated discs or other spinal injuries, heart attack, stroke, miscarriage or other pregnancy complications, irreversible damage to the spinal cord or nervous system, or mental injuries.  As a condition of participating in Cycle614’s activities, you acknowledge and accept these risks.  Further, you, on behalf of yourself and your heirs, assigns, and legal representatives, hereby waive, release, and discharge Cycle614 from any and all claims, demands, rights, causes of action, or liability from death, injury, or damages arising from or in any way connected with your use of Cycle614’s services, facilities, equipment, or machinery (including during any rest periods or breaks), including any death, injury, or damages resulting from the negligent actions or omissions of Cycle614. 

 You assume full responsibility for your use of Cycle614's services, facilities, equipment, and machinery, and you shall indemnify Cycle614 against any and all liability or damages arising out of your use of Cycle614’s services, facilities, equipment, and machinery. Additionally, you and your guests shall hold Cycle614 harmless from any loss, theft, cost, claim, injury, damage or liability incurred as a result of Cycle614 use and client activities.

 Coronavirus/COVID-19 Supplemental Waiver

 The novel coronavirus, COVID-19, has been declared a worldwide pandemic by numerous federal, state, and local governmental entities and health authorities, and COVID-19 infections have been confirmed in Ohio.  COVID-19 is considered highly contagious and poses serious health risks to those who contract it.  It is still not fully known how COVID-19 is spread, and it is believed that individuals with no symptoms of COVID-19 can still be carriers of the disease and cause infection in others.  Although COVID-19 is considered most dangerous to people with advanced age or pre-existing health conditions, there are numerous cases of young, otherwise-healthy people with no known pre-existing conditions becoming seriously ill or dying as a result of COVID-19.  Further, the long-term effects of COVID-19 infection are still largely unknown.

 Because of the highly contagious and potentially life-threatening nature of COVID-19, you should carefully consider your own risk factors and pre-existing conditions that could result in substantial health complications (including death) due to COVID-19, including age, respiratory or heart disease, overweightness or obesity, frailty, osteopenia/osteoporosis, diabetes, hypertension, immunodeficiency diseases, cancer, or any other chronic conditions.  You alone are responsible for deciding if you wish to enter Cycle614 while the COVID-19 pandemic is ongoing.  You should consult a competent medical professional to ascertain the risks that COVID-19 poses to your health and well-being before deciding to enter Cycle614.

 Cycle614 has taken numerous steps to implement recommended guidance and protocols issued by governmental authorities and public health agencies for slowing the transmission of COVID-19, and may revise them based on updated recommendations and guidance from governmental and public health authorities.  However, Cycle614 cannot guarantee that you will not be exposed to or infected by COVID-19.  Further, given the nature of fitness and exercise activity with Cycle614, the risk of exposure to COVID-19 may be more significant than other places of public accommodation, and some recommendations relating to COVID-19 by governmental and public health agencies may not be possible to follow, or may not be possible to follow at all times.  ENTERING CYCLE614 WILL LIKELY INCREASE YOUR RISK OF EXPOSURE TO COVID-19.

 Given the dangers posed by COVID-19, it is imperative that you follow all policies, procedures, and protocols that Cycle614 may prescribe to reduce the risk of exposure to COVID-19, whether or not identified in this Agreement.  Failure to follow such safety rules can result in suspension or termination of services at Cycle614’s sole discretion. These policies include the following:

1. You must follow all written and oral directives by Cycle614, even if not specifically identified in this Agreement.
2. You must follow all federal, state, and local laws, including those related to COVID-19.
3. You may not enter tCycle614 if you have had within the previous 14 days any symptoms potentially related to COVID-19, including fever, body aches, cough, shortness of breath or other respiratory difficulties, tiredness, sore throat, diarrhea, nasal congestion, nausea, vomiting, or loss of taste or smell.
4. You may not enter Cycle614 if you have had any contact within the previous 14 days with anyone who has a suspected or confirmed case of COVID-19.
5. You may not enter Cycle614 if you have, within the previous 14 days, returned from a highly impacted area subject to a Center for Disease Control (CDC) Level 3 Travel Health Notice, or been exposed to any person who has returned from an area subject to a CDC Level 3 Travel Health Notice. 6. You may not enter Cycle614 if you have been diagnosed with COVID-19 within the previous 21 days, or are under quarantine, separation, or observation due to having a potential or suspected case of COVID-19.
7. You must maintain at least 6 feet of space from all other persons to the extent possible, and it is highly recommended that you avoid all physical contact with other individuals.
8. You must wash hands thoroughly and frequently while at Cycle614, including at minimum when you enter Cycle614 and before or after using any Cycle614 equipment or machinery.
9. You must clean all equipment with disinfectant spray or wipes immediately after use.

 As a condition of participating in Cycle614’s activities, you acknowledge and accept these risks.  Further, you, on behalf of yourself and your heirs, assigns, and legal representatives, hereby acknowledge and accept the risks posed by COVID-19 as a result of using Cycle614’s services, facilities, equipment, and machinery.  Further, you hereby waive, release, and discharge Cycle614 from any and all liability from illness, injury, death, or damages arising from, or in any way connected with, exposure to or infection with COVID-19 in connection with your use of Cycle614’s services, facilities, equipment, or machinery, including any illness, death, injuries or damages resulting from the negligent acts or omissions of Cycle614.

 Children Under Age 13
We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please DO NOT attempt to register on our website or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on our website. In the event that we learn that any personal information has been submitted to the website from a child under age 13, we will delete that information as quickly as reasonably possible. If you believe that we might have any information from or about a child under 13, please contact us at cycle614.com.

 Children Between the Ages of 13 and 18
If you are between the ages of 13 and 18, you may register on our website only with the involvement of a parent or guardian.

 MEDICAL1. Medical Recommendations. Client should consult with his or her physician or have a physical examination before using any of Cycle614's services, facilities, equipment, or machinery or enrolling in any of the Cycle614's classes, especially if client is elderly; pregnant; has a history of heart disease, high blood pressure or other chronic illness; is unaccustomed to physical exertion; or has other physical limitations.   

1. Client is strongly encouraged to request and take advantage of the free initial orientation - including bike fitting - and ongoing support available to ensure the proper and safe use of all of the Cycle614's equipment.
2. Client Conduct. Client shall not use any Cycle614 facilities, service or equipment in such a way as to endanger the health or safety of Clients or others, and failure to do so may result in suspension or termination of membership and/or services at Cycle614’s sole discretion. Client shall be responsible for any property damage or personal injury caused by Client or his or her guests. Client agrees not to violate any laws while in Cycle614.
3. Medical Disclaimer. Client has been informed and acknowledges that the Cycle614 makes no claims as to medical or fitness results that can or may be obtained through use of the Cycle614's facilities, equipment or services. Cycle614 has neither suggested nor will suggest any medical treatment to Client. Only licensed medical professionals are qualified to give medical advice.
4. Client's Health Warranty. Client represents that: i. there are no medical or physical conditions that would preclude his or her use of the Cycle614's services, facilities, equipment, or machinery; ii. he or she has not been instructed by any physician not to participate in activities of Cycle614; and iii. he or she is in good health and has no disability, impairment, injury, disease or ailment preventing him or her from engaging in active or passive exercise or which could cause increased risk of injury or adverse health consequences as a result of exercise. Client agrees to immediately notify Cycle614 if s/he develops, is diagnosed with, or suffers from any medical, physiological, or psychological condition that would limit or preclude Client’s participation in such physical activity.
5. Disclaimer of Warranties. B Although Cycle614 will endeavor to provide effective principles to meet Client’s fitness and personal goals, it cannot guarantee that any products, programs, methods, workouts, or routines will be safe, effective or suitable for everyone. All such products and services, programs, techniques and materials are offered without warranties or guaranties of any kind, express or implied, including but not limited to warranties of safety or fitness for any particular purpose.

MISCELLANEOUS PROVISIONS

1. Prevailing Party. In the event Client commences an action against Cycle614 or its owners and/or employees and fails to obtain judgment or partial judgment in Client's favor, Client shall be liable to the Cycle614 for all costs and expenses associated with Cycle614's defense of the action or any claims on which Client did not prevail, including attorney’s fees and costs.
2. Costs of Collection. Client agrees to pay all costs plus reasonable attorney’s and collection fees in connection with Cycle614 (or Club’s designee’s) collection of any amounts owed by Client.
3. Loss of Property. Client is urged not to bring valuables onto Cycle614's premises and to keep valuables with him or her at all times. Cycle614 shall not be liable for the disappearance, loss or theft of, or damage to, personal property - including money, negotiable securities and jewelry.
4. Scope of Waiver. The releases, waivers, indemnity agreements, and assumptions of risk contained herein are intended by both parties to be as broad and inclusive as permitted by Ohio law.  If a court of competent jurisdiction, or any other legal authority or governmental agency, declares any provision of this agreement invalid, such invalidation shall not affect the remaining provisions of this agreement, which shall remain in full force and effect.  If any sentence, clause, phrase, or term of any section of this agreement is deemed invalid, the remainder of that section shall remain in full force and effect.

 I have read this agreement in its entirety and agree to adhere to all its precepts. This agreement is governed by the laws of the State of Ohio.  This document encompasses the entire agreement of the parties with respect to the subject matters identified herein, and supersedes all prior oral and written representations between the parties, if any, regarding those subject matters.  This agreement may be amended only by a written agreement, signed by both parties.
