Liability Waiver

For purposes of the following provisions, Cycle614 includes Cycle614 and its owners, officers, representatives, employees, agents, independent contractors, or insurers.
General Liability Waiver and Indemnification Agreement
Cycle614 is not responsible in any way for the safekeeping of your personal belongings while attending a class.
Participation in classes at Cycle614, and the use of Cycle614’s services, facilities, equipment, and machinery could result in injury, permanent disability, or death, including but not limited to overexertion injuries (such as fainting, heat exhaustion, or rhabdomyolysis), broken bones, damaged connective tissue, herniated discs or other spinal injuries, heart attack, stroke, miscarriage or other pregnancy complications, irreversible damage to the spinal cord or nervous system, or mental injuries. As a condition of participating in Cycle614’s activities, you acknowledge and accept these risks. Further, you, on behalf of yourself and your heirs, assigns, and legal representatives, hereby waive, release, and discharge Cycle614 from any and all claims, demands, rights, causes of action, or liability from death, injury, or damages arising from or in any way connected with your use of Cycle614’s services, facilities, equipment, or machinery (including during any rest periods or breaks), including any death, injury, or damages resulting from the negligent actions or omissions of Cycle614.
You assume full responsibility for your use of Cycle614's services, facilities, equipment, and machinery, and you shall indemnify Cycle614 against any and all liability or damages arising out of your use of Cycle614’s services, facilities, equipment, and machinery. Additionally, you and your guests shall hold Cycle614 harmless from any loss, theft, cost, claim, injury, damage or liability incurred as a result of Cycle614 use and client activities.
Coronavirus/COVID-19 Supplemental Waiver
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by numerous federal, state, and local governmental entities and health authorities, and COVID-19 infections have been confirmed in Ohio. COVID-19 is considered highly contagious and poses serious health risks to those who contract it. It is still not fully known how COVID-19 is spread, and it is believed that individuals with no symptoms of COVID-19 can still be carriers of the disease and cause infection in others. Although COVID-19 is considered most dangerous to people with advanced age or pre-existing health conditions, there are numerous cases of young, otherwise-healthy people with no known pre-existing conditions becoming seriously ill or dying as a result of COVID-19. Further, the long-term effects of COVID-19 infection are still largely unknown.
Because of the highly contagious and potentially life-threatening nature of COVID-19, you should carefully consider your own risk factors and pre-existing conditions that could result in substantial health complications (including death) due to COVID-19, including age, respiratory or heart disease, overweightness or obesity, frailty, osteopenia/osteoporosis, diabetes, hypertension, immunodeficiency diseases, cancer, or any other chronic conditions. You alone are responsible for deciding if you wish to enter Cycle614 while the COVID-19 pandemic is ongoing. You should consult a competent medical professional to ascertain the risks that COVID-19 poses to your health and well-being before deciding to enter Cycle614.
Cycle614 has taken numerous steps to implement recommended guidance and protocols issued by governmental authorities and public health agencies for slowing the transmission of COVID-19, and may revise them based on updated recommendations and guidance from governmental and public health authorities. However, Cycle614 cannot guarantee that you will not be exposed to or infected by COVID-19. Further, given the nature of fitness and exercise activity with Cycle614, the risk of exposure to COVID-19 may be more significant than other places of public accommodation, and some recommendations relating to COVID-19 by governmental and public health agencies may not be possible to follow, or may not be possible to follow at all times. ENTERING CYCLE614 WILL LIKELY INCREASE YOUR RISK OF EXPOSURE TO COVID-19.
Given the dangers posed by COVID-19, it is imperative that you follow all policies, procedures, and protocols that Cycle614 may prescribe to reduce the risk of exposure to COVID-19, whether or not identified in this Agreement. Failure to follow such safety rules can result in suspension or termination of services at Cycle614’s sole discretion. These policies include the following:
As a condition of participating in Cycle614’s activities, you acknowledge and accept these risks. Further, you, on behalf of yourself and your heirs, assigns, and legal representatives, hereby acknowledge and accept the risks posed by COVID-19 as a result of using Cycle614’s services, facilities, equipment, and machinery. Further, you hereby waive, release, and discharge Cycle614 from any and all liability from illness, injury, death, or damages arising from, or in any way connected with, exposure to or infection with COVID-19 in connection with your use of Cycle614’s services, facilities, equipment, or machinery, including any illness, death, injuries or damages resulting from the negligent acts or omissions of Cycle614.
Children Under Age 13
We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please DO NOT attempt to register on our website or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on our website. In the event that we learn that any personal information has been submitted to the website from a child under age 13, we will delete that information as quickly as reasonably possible. Children Between the Ages of 13 and 18
If you are between the ages of 13 and 18, you may register on our website only with the involvement of a parent or guardian.

Client should consult with his or her physician or have a physical examination before using any of Cycle614's services, facilities, equipment, or machinery or enrolling in any of the Cycle614's classes, especially if client is elderly; pregnant; has a history of heart disease, high blood pressure or other chronic illness; is unaccustomed to physical exertion; or has other physical limitations.
MISCELLANEOUS PROVISIONS
I have read this agreement in its entirety and agree to adhere to all its precepts. This agreement is governed by the laws of the State of Ohio. This document encompasses the entire agreement of the parties with respect to the subject matters identified herein, and supersedes all prior oral and written representations between the parties, if any, regarding those subject matters. This agreement may be amended only by a written agreement, signed by both parties.
